Relevant Facts Alex and his girlfriend, Elizabeth, live within the state of Washington. Alex is twenty-seven and his girlfriend is twenty-one. Elizabeth wants to become a cardiologist one day. Alex finds out that Elizabeth is pregnant and wants to give the baby up for adoption. Alex, however, wants to be a parent to the unborn child. Both Elizabeth and her parents believe the baby would be better off with a stable married couple.

After a genetic test is complete then Alex must attempt to exercise his rights as a parent under Rev. Code Wash. (ARCW) § 26.26.505 through joint custody or another form of parentage acknowledgement such as child support. According to statute Rev. Code Wash. (ARCW) § 26.33.160, Alex would need to give consent to an adoption in order for it to be finalized after he establishes his paternity.

2) Contrast Alex’s rights with Elizabeth’s rights. In your conclusion, speculate what the likely outcome should be in this case. Be sure to cite relevant statutory law for each conclusion. Alex would need to establish his rights of paternity to the unborn child through genetic testing, acknowledgement, or some form of custody action. Elizabeth on the other hand, is automatically the presumed mother based on Rev. Code Wash. (ARCW) § 26.26.101 because she will be the one to give birth to the child in the future. Alex will have the right to adopt the child once paternity is established, and Elizabeth will then need his consent in order to put the child up for adoption according to statute, Rev. Code Wash.
